Privacy Policy

 

 

General rules

These privacy rules (hereinafter referred to as Regulations) define the main principles and procedures for regulating the use of visitor (hereinafter – Your) personal data by Tomega SIA (hereinafter – Tomega) on the tomshop.lv website, which is located at the Internet address of http://www.tomshop.lv.

 

The personal data that You submit in website tomshop.lv will be used in accordance with the EU General Data Protection Regulation, the Privacy Act, as well as other legislation in force in the Republic of Latvia governing the use and protection of personal data, as well as the company's personal data processing policy.

 

When processing Your personal data on website tomshop.lv, we use reliable organisational and technical means, providing security for this data from accidental or unlawful destruction, change, disclosure and any other illegal activity.

 

Direct marketing.

Your personal data (given name, surname, e-mail address) is processed for direct marketing purposes according to Your consent. If You do not agree to be addressee of direct marketing, Tomega will not be able to communicate useful and up-to-date information to You.

Registration, information material, personal data collected at the time shall only be used to send out our information material. They also allow us to inform the recipients of the information material via e-mail, to the extent necessary for the provision or registration of the information material service, for example when the information material is altered or the technical parameters are changed. Personal data collected during the provision of information material services will not be transferred to third parties. The person involved may stop receiving information material at any time. At any time, it is possible to cancel our agreement on the storage of personal data, which allows us to send out the information material. Each information material received contains a link to the cancellation form, which allows the person concerned to stop receiving it.

 

Taking pictures and filming at Tomega events.

Images in which cannot identify particular person shall be published freely. For example, overview with many people, group pictures, event location, hand holding a mug, card, etc. we may publish pictures of those who have agreed of being photographed. The use of images for journalism will remain valid if it is done with a view to publishing information concerning Tomega's interests.

Both the information materials of the event and possibly tickets or participant cards will indicate that during event pictures will be taken and images then be published on social networks or other publicly available sites. You have the right to ask that to not photograph You or that the images do not appear publicly with You.

 

Indoor video surveillance.

Video surveillance in public places is the legitimate interests of an organisation or company, such as order provision, theft protection, fraud. Video surveillance

 

is performed to detect thefts and misunderstandings. The video material shall be stored for up to 14 days and shall be transferred to third parties – law officer, in the event of an infringement. The employees shall be informed about video surveillance at the premises, as well such information shall be indicated by the informative labels.

 

An informative label shall be present and indicate of video surveillance in the company and its premises. The company will be entitled to submit video files to law enforcement authorities (police, prosecutor's office, etc.) for the defence of its legitimate interests.

 

Ordering items.

Personal data - given name, surname, e-mail, telephone number, delivery address, personal identity number (referring to the accounting law) are processed to enter into a contract and used in accordance with Your permission. If You do not submit your data in this section, we will not be able to accept Your orders. Once the Parties conclude the agreement, such data will be processed and used for the following purposes: performance of the contract, orders and supply of Tomega goods.

Data required for legal persons — name, surname, address, e-mail address, phone number

of the contact person.

 

Service application.

To be able to provide Tomega service to You, we need the following information: customer/business name, contact person’s name, surname, telephone number, e-mail address, facility location address, product type, model, serial number, purchase date, application type (maintenance, repair), problem description.

 

All service-related events are recorded in a single company service management system. This allows the client to familiarise himself with the type, size, and progress of the works performed, and to obtain reports on the services provided and the history of process progress.

 

Personal data of the candidates.

Candidates may submit their CVs directly by e-mail and through job advertising portals, which include name, surname, date of birth, address, telephone number, e-mail, education, work experience, skills, driver’s license information, computer skills, job-related questions and wages, and other information. The candidate’s personal data is processed with purpose to select and find candidates. The candidate's personal data shall be processed on the basis of his/her permission expressed when submitting his/her CV to the employer. Non-qualified CVs submitted by candidates are destroyed/deleted.

 

At the time of candidates selection, we only use information about qualifications, professional skills and essential qualities. We do not collect or process personal sensitive data.

 

Processing other (non-personal) data.

Data other than your personal data or cookies (SEO, Adwords, cookies, pixel, etc.), related to Your service orders on the tomshop.lv site, may be used to create anonymous statistical studies. In all cases, the use of such data will not reveal your identity directly or indirectly. In some cases, we remain entitled to transfer the results of anonymous statistical studies to third parties.

 

Access to personal data for third parties.

Your personal data may be available to third parties who process them to provide us with support for the maintenance of the site and the protection of Your data. Such third parties could be sellers of database programs, database maintenance providers, cloud service providers, etc. Your personal data may be transferred to intermediaries and/or media as well as to Tomega Group companies. Similarly, Your data may be transferred to law enforcement authorities, such as the State Police and other supervisory authorities, when requested by applicable law, or to protect our rights or to ensure the security of our customers, employees and resources.

 

Except in the cases specified in these Regulations, and in compliance with the requirements of the regulatory enactments of the Republic of Latvia, without Your prior permission, we will not disclose your personal data to third parties.

 

Information on Your computer.

We reserve the right to record information (usually referred to as “cookies”) on Your computer when You visit the home page of tomshop.lv. This information makes it easier to use tomshop.lv and excludes the need to enter personal data during each visit. You can delete this information from Your computer or block it from using it by changing the settings in Your Internet browser.

 

Submission and updating of personal data.

In order to make Your requests and ordered services more efficient and accurate, we need to obtain accurate data from You. You must provide accurate data and update the information as soon as possible if it has changed.

 

Third-party home pages.

We are not responsible for managing Your personal data that is in possession of third parties. We are not responsible for privacy rules and third-party homepage activities even when You visit home pages through tomshop.lv. We recommend that You consult the privacy rules of each home page separately.

 

Data storage time.

We shall use and store your personal data for no longer than is necessary for the purposes set out in this Regulation.

 

Your rights.

In relation to Your personal data, you have the following rights:

 ·        request permission from Tomega to access, rectify and delete Your personal data, and limit the use of data;

·        the right to object to the processing of data;

·        the right to receive your personal data in a structured, frequently used and in format often viewed in electronic devices (right to data portability);

·        the right to withdraw your consent at any time without affecting legality of processing carried out prior to the withdrawal of consent;

·        right to submit complaint with the Data State Inspectorate.

Rights can be used when writing to Tomega electronically by email gdpr@tomega.lv.

You have the right not to provide to us Your personal data. However, the submission of personal data is necessary to achieve the objectives set out in the Regulation. If you decline to submit Your personal data, Tomega will not be able to provide You with their services.

Copyright.

The copyright of the information provided belongs to the natural and legal persons identified in the text and graphical information. In the absence of a reference to third-party copyright with the information, the right to the information shall belong to Tomega.

Final provisions.

The regulatory enactments in force in the Republic of Latvia shall apply to these Regulations. All disagreements will be negotiated. If no mutual agreement is reached, disputes will be dealt with in the Republic of Latvia in court in accordance with the regulatory enactments in force in the Republic of Latvia.
